Minimum Staffing Standards for Long-Term Care Facilities and Medicaid Institutional Payment Transparency Reporting*

This final rule establishes minimum staffing standards for long-term care facilities, as part of the Biden-Harris Administration’s nursing home reform initiative to ensure safe and quality care in long-term care facilities. In addition, this rule requires States to report the percent of Medicaid payments for certain Medicaid-covered institutional services that are spent on compensation for direct care workers and support staff.

Hazardous Drug Exposures**

The NIOSH publication 2023-130, titled “Managing Hazardous Drug Exposures: Information for Healthcare Settings,” provides guidelines for managing and mitigating risks associated with hazardous drug exposure in healthcare environments. It outlines control strategies, including engineering controls, administrative controls, and personal protective equipment, and emphasizes the importance of facility-specific risk assessments to determine effective exposure controls.

Nursing Home Medication Malpractice***

Serious or deadly medication errors in nursing homes may result from staff medical malpractice. Such cases include:

  • Medication Diversions: Staff may steal medication for personal use or to sell.
  • Ignoring Orders: Employees might alter, add, or discontinue medications against orders.
  • Medication Borrowing: Staff might give the wrong resident another’s medication during busy times.
  • Poor Medication Management: Facilities may fail to have necessary medications available.
  • Unauthorized Medication Administration: Giving medication without consent can cause harm.

Improper medications can worsen conditions or cause new side effects. In one case, a resident was put into a coma after taking medication meant for her roommate due to a mix-up.
